Terms of Service

Draft for review. These terms describe how PillowFare actually works, but have not been reviewed by counsel — have a lawyer review them (especially the payments, membership, liability, and dispute sections) before publishing.
These Terms of Service (“Terms”) govern your access to and use of PillowFare, including the website at pillowfare.com, our mobile app, and related services (collectively, the “Service”), provided by PillowFare LLC, a Montana limited liability company (“PillowFare,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.
1. The Service
PillowFare is a hotel search-and-booking service. We show live hotel rates and let you book a stay. When you book, we arrange the reservation on your behalf through our travel-technology provider, LiteAPI (operated by Nuitée Travel), which sources availability and pricing from hotels and their suppliers. The stay itself is provided by the hotel under its own rules and policies.
We do not currently offer flights, car rentals, or other travel products. References to those in older materials no longer apply.
2. Transparent pricing
Our pricing model is simple and the same every time: the price you see is a flat markup over the supplier’s wholesale rate — 15% for the public, and 10%for members — and that price already includes taxes and our fee. We don’t add surprise “service fees” at checkout. In some cases a supplier’s minimum allowed selling price is higher than our markup; where that applies, the displayed price reflects it. Prices and availability are live and can change until you complete a booking.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a booking. By using the Service you represent that you meet this requirement and can enter into these Terms.
4. Your account
4.1 Account creation
You can create an account with an email address and password, or sign in using a passkey (WebAuthn). You agree to provide accurate, current information and to keep it updated.
4.2 Account security
You’re responsible for keeping your password and passkeys secure and for activity under your account. Notify us at [email protected] immediately if you suspect unauthorized access.
4.3 One account per person
You may not create multiple accounts to circumvent rate limits, abuse the referral program, or evade enforcement actions.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Scrape, crawl, or harvest content, rates, or user data without our written permission.
- Interfere with or disrupt the Service, including by overwhelming our infrastructure, exploiting bugs, or bypassing rate limits.
- Attempt to gain unauthorized access to any accounts, systems, or networks.
- Use bots or automated means to interact with the Service except through APIs we explicitly provide.
- Misuse the contact form to send spam, phishing, or harassment.
- Make fraudulent or speculative bookings, or bookings you don’t intend to honor.
- Resell, sublicense, or redistribute the Service or its content without our permission.
6. Bookings
6.1 How a booking works
When you complete a booking, we submit it to the hotel through LiteAPI and confirm it on your account. Your reservation is subject to the hotel’s rules and to LiteAPI’s supplier terms, which we surface during checkout (for example, the room type, board, and the cancellation policy).
6.2 Accuracy
We do our best to display accurate availability, prices, and descriptions, but rates and inventory are live and supplier-sourced; we can’t guarantee they’re error-free. The final price and terms are confirmed at the moment you book.
6.3 Cancellations, changes, and refunds
Each booking shows its cancellation policy and free-cancellation deadline before you pay. For eligible bookings you can request a cancellation from your bookings page, and we will process it through LiteAPI; the supplier calculates and confirms the final refund or fee. Non-refundable bookings, and cancellations after the free-cancellation deadline, may receive no refund or a partial refund as the policy provides. Changes to dates or guests generally require cancelling and re-booking, subject to the same policy.
6.4 No travel advice
PillowFare doesn’t provide travel, immigration, visa, health, or insurance advice. You’re responsible for meeting all requirements to travel to your destination.
7. Payments
7.1 Hotel payments
You pay for a booking through a secure payment form provided by LiteAPI. Your card details are handled by LiteAPI’s payment provider; PillowFare never receives your full card number. By paying, you authorize the charge for the displayed total, which already includes taxes and our fee.
7.2 Membership billing
PillowFare membership is billed through Stripe, Inc. By subscribing you also agree to Stripe’s terms. Stripe stores your card as a token; PillowFare doesn’t see or store full card numbers.
7.3 Disputes
If you believe a charge is incorrect, contact us within 60 days at [email protected] before initiating a chargeback, so we can work to resolve it.
8. PillowFare membership
Membership is an optional, paid subscription that unlocks our lower member markup (10% over wholesale instead of the public 15%).
- Recurring billing. Membership is billed in advance on a recurring basis (monthly unless stated otherwise) to your payment method on file, and renews automatically until you cancel.
- Cancel anytime. You can cancel from your account at any time. Cancellation stops future renewals and takes effect at the end of the current billing period; you keep member pricing until then.
- Fees.Membership fees are charged for the period they cover and are generally non-refundable except where required by law. We’ll give notice before any price change.
- Savings aren’t guaranteed. Member pricing lowers our markup, but total savings depend on the rates available for the stays you book.
9. Referral program
We may offer a referral program that gives you a personal link to share. Referral credit, vouchers, and any benefits are discretionary, have no cash value unless and until we credit your account, are non-transferable, and may be modified or discontinued with notice. We may withhold or revoke benefits for abuse, fraud, or self-referral. Current terms are shown on the referrals page.
10. User content
If you submit content to PillowFare (for example, through the contact form or a future review feature), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content to operate and improve the Service. You retain ownership of your content and represent that you have the right to submit it and that it doesn’t infringe any third-party rights.
11. Our intellectual property
The Service — including software, design, logos, copy, and the PillowFare name — is owned by PillowFare LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial travel-planning purposes, subject to these Terms.
Third-party names and marks (e.g. LiteAPI, Stripe, hotel brands, GeoNames, OpenStreetMap) are the property of their respective owners and used here for identification only.
12. Third-party links and services
The Service contains links to and content from third parties. We aren’t responsible for the availability, content, or practices of any third-party site, and your interactions with third parties are between you and them.
13. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
We don’t warrant that the Service will be uninterrupted, error-free, or secure; that defects will be corrected; or that prices, availability, or listings will be accurate or complete. The hotel — not PillowFare — is responsible for providing the stay.
14. Limitation of liability
To the maximum extent permitted by law:
- PillowFare will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, or loss of goodwill, arising from or related to your use of the Service.
- Our total aggregate liability for all claims related to the Service will not exceed the greater of (a) the total fees you paid to PillowFare in the 12 months before the claim, or (b) one hundred U.S. dollars (US $100).
Some jurisdictions don’t allow these limitations, so they may not apply to you in full.
15. Indemnification
You agree to indemnify and hold harmless PillowFare LLC, its officers, members, employees, and agents from any claim, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party right.
16. Termination
You may delete your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, miscellaneous) continue to apply.
17. Governing law and dispute resolution
17.1 Governing law
These Terms are governed by the laws of the State of Montana, USA, without regard to its conflict-of-laws principles.
17.2 Informal resolution first
Before filing any claim, you agree to first contact us at [email protected] with a written description of your dispute and to allow 60 days for good-faith resolution.
17.3 Venue
You and PillowFare agree to the exclusive jurisdiction of the state and federal courts located in Montana, USA, for any dispute not resolved informally. (We have intentionally not required binding arbitration.)
17.4 Class action waiver
To the extent permitted by law, you and PillowFare each waive the right to bring or participate in any class, collective, or representative action against the other.
18. Changes to these Terms
We may update these Terms from time to time. The “Effective” date above reflects the current version. For material changes, we’ll notify you by email or a prominent notice on the Service. Continued use after the effective date constitutes acceptance.
19. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and PillowFare regarding the Service and supersede prior agreements.
- Severability. If any provision is unenforceable, the rest remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delays or failures due to causes beyond reasonable control (natural disasters, war, pandemic, government action, infrastructure outages, etc.).
- Headings.Headings are for convenience only and don’t affect interpretation.
